On Thursday, January 10, 2008, the Louisville Metro Council passed a new smoking ban, less than a month after the city’s old smoking ban was overturned by a judge. The old smoking ban had been in effect since July 1 and was overturned on December 21 when a judge ruled that an exemption for Churchill Downs was unconstitutional. Restaurants, bars, bingo halls and bowling alleys are all included in the new smoking ban. The new ban has just one exemption – for manufacturers that perform research and development on tobacco products. Beginning on Friday, businesses must have “no smoking” signs posted inside their buildings, remove all ashtrays and tell any patrons who try to smoke that they must stop. If the patron refuses, business owners are required by the ordinance to ask them to leave. One new change to the ordinance states that if inspectors see multiple violations of the ban during a single inspection, they can only give the business owner one citation.Kentucky
